I posted in detail about how on moving I muddled my Council Tax and was astonished at the speed with which Edinburgh City Council set the bailiffs upon me. Through my local MP I have now received clarification that Edinburgh City Council take people to court as soon as their payment is 42 days late.

I find that absolutely incredible. People are human, they make mistakes, they may be temporarily short of cash. I cannot think of any other body that is so aggressive in subjecting people to the judicial system for a small delay. No commercial company would dream of taking people to court for just being 42 days late, the utility companies and banks would in fact not to be allowed to do so by regulators and the inland revenue certainly are much less predatory.

Do not misunderstand me. People should pay their tax, on time. I tried to pay mine 46 days late for which I apologise and am happy to accept a late payment penalty. But I can think of absolutely no reason why it was necessary to take me to court for paying my Council Tax in May instead of April.

Actually I can think of one reason – to make enormous money for Scott & Co, the bailiffs. I tried to pay by online direct debit on 25 May, not knowing that on 19 May Edinburgh Council had already referred me to court. My payment appeared accepted and I got a confirmation number from Edinburgh City Council. Three days later, on 28 May, they obtained a court warrant against me. Edinburgh City Council have not taken any payment from my direct debit and they refuse to take any payment from my direct debit. They both refuse to take the payment and at the same time continue to harass me for non-payment.

The reason is they have no interest in collecting my tax. What they want is to make money for Scott & Co., a private company owned by an extremely wealthy husband and wife partnership. I cannot now pay Edinburgh City Council but have to make the payment to this private company including their exorbitant fees.

I have no objection to paying any late penalty to Edinburgh City Council, but when any City Council in Scotland is primarily interested in channeling money to a private company and making millionaire parasites richer, then I look at the size of the houses and value of the cars of councillors, ex-councillors, and senior officials and I ponder, deeply.

    Fred it’s illogical to say, increasing the Council tax will help the poor,when the poor cannot afford to pay the increase in the first place.

    I agree that if some sort of arrangement could be made to increase the Council tax of the well to do, it would then be helpful to the rest of the community.

    Something the Scottish Government could take on board.

    It isn’t rocket science. An increase in council tax would be paid by the rich who have an excessive disposable income. People on a low income will still be guaranteed the money they need to live on plus 20% same as they are now, they will pay no extra. The extra money raised can be spent on things like care of the elderly, disabled, disadvantaged and the poor, libraries, the things being presently threatened by council cutbacks.

    you will be aware that that is inherent in the way the Council tax system (based on a limited number of tax bands)works.

    Now, Mrs Thatcher’s poll tax, whichg was a per caput tax, would probably go some way to meeting your strictures because there are probably quite a few courtiers and so on living in the Royal palaces.

    I should never have thought you were a supporter of the late and very much lamented poll tax, RoS.

    As far as I can remember that’s always been standard practice. And both the council and Scott (see my link) make no secret of this. Moral: read the terms and conditions. Electricity companies, on the other hand, will insist on putting a pay-meter in if you can’t meet their demands. Maybe that would be a better solution.

    I find it really inspiring to think that all that money the Government is clawing back from council grants is being spent on the deserving, though:

    “Your Council would not be alone in taking that line.

    Paying Council tax in “x” monthly installments is a facility which Councils (at least most if not all of them) offer to ratepayers and which can be withdrawn in certain circumstances.”

    O/T After several (relatively) serene years when I’ve been able to painlessly excise the worst excesses of the trolls, Habbabreak has stopped working for me. When I look at my Add-On Preferences, there’s a message telling me that Habbabreak has been removed ‘due to its negative effects’.

    I can’t say I noticed any ‘negative effects’; and the prospect of having once again to wade through the sort of destructive drivel generated by the worst offenders is not a pleasant one. If anyone has any suggestions about how to avoid this fate, I (and, I suspect, others too) would greatly appreciate them.

    Council tax. The underclass are pavlov trained to sing campfire songs celebrating freedom. Wiki cannot help. I wish I could say more. Discipline tames the tongue and corrects the incorrect songs. These are dark days. Our only glimmer is non-payment and the jesting of slow authority. Nothing here to see. Lo siento, no puedo decir más.

    I was trying to explain this from a position of a small Landlord..who had rented his one of two flats to his Musician Mates…who never paid their bills.

    And it wasn’t them the Council who came after..They came after him…

    He asked me if I could give him a short term loan of £4,000 to pay off the council….

    I said you what…I wouldn’t even lend £4,000 to my brother..under such circumstances…

    But I spent 2 hours finding out about the legal situation when Bailiffs come round..to Repossess anything of Value in Your Home.

    Number 1..Don’t Agree and Let Them In.

    Number 2..Ensure All Your Windows are Secured…so They Can’t Break In

    Breaking In is not allowed by The Law…If You Open The Door and Let Them In..They Can Clean You Out.

    But I wasn’t allowed to write the rest about these things..well I wrote it…just on here..And someone just deleted it.

    I was not impressed cos I didn’t mention anyone’s names and no one would be able to guess.

    Why did you delete that?? Most of it was Really Nice.

    I also got it sorted for him..I said all you have got to do is sign this piece of paper…well a bit more but basically that was it…all the rest had been organised including his new tenant who he seriously does not get on with…But he doesn’t have to live him.

    But his mind doesn’t work like that. He has an empty flat…and he doesn’t mind his mates staying there for free.

    I am not sorry for sorting it out. I know them both really well. They might not like each other..but that is not the point. They both have their homes to live in…If no one had done anything to sort this mess out..they could both have ended up homeless. You need to know the law.
