    Another great certainty regarding human nature and patterns of influence or conditioning is sex. I have taken some photographs of birds in my locality including kingfishers, woodpeckers, cormorants and little egrets but the one which gets a larger proportion of views is our common great tit. Voting patterns are similar.

    Putting aside that survivors (of a certain opinion) who agree that Israel is committing genocide. Which you clearly agree with as you haven’t attacked their stance, and wouldn’t dare to. I take your point that others see it differently.

    From my own point I merely questioned the number, but I now feel that in itself is irrelevant. It may come as a surprise to you Habb, but I don’t hate J××ish or Israeli people.

    I however cannot condone, their acts in the Middle East anymore than I could condone Russias in Afghanistan or China’s in Tibet.

    Yes – it’s very depressing.

    Do you remember the last act of Bill Clinton was to pardon Marc Rich and now Obama has released Jonathan Pollard.

    He knows where his future lies as did Tony Blair.

    The lobbying, money and hatred in the US work so effectively.

    Nowhere, in the US campaign, have I seen anyone mention the tax dollars sent to Israel. This at a time when a recent FT report said 12 million Americans were living on $1 a day.

    I suppose some of those tax dollars are being paid to Habba for trying to defend the indefensible!

    Personally, I don’t think there is anything better, but I probably don’t describe family and friends as well as I should..

    Donna Edwards is one congresswoman who has not supported all the legislation AIPAC has supported. Consequently, AIPAC is supporting her opponent Chris van Hollen in the forthcoming primary to decide which Democrat will run for the Maryland Senate seat Barbara Mikulski is vacating as a result of her retirement. Edwards is currently slightly ahead in the polls. She’s one politician who has had the courage to defy AIPAC. It will be interesting to see if she can win her primary.

    You correctly quote Lembkin as follows:

    “By “genocide” we mean the destruction of an ethnic group….     That quotation contains the key condition for establishing the existence of a genocide and that key condition is of course reproduced, albeit in slightly different language, in the 1951 UN Genocide Convention, Article 2 of which reads as follows:

    “Article II

    In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:

    (a) Killing members of the group;

    (b) Causing serious bodily or mental harm to members of the group;

    (c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;

    (d) Imposing measures intended to prevent births within the group;

    (e) Forcibly transferring children of the group to another group.”

    That key condition is *intention*, expressed by Lembkin as “the aim of annihilating the groups themselves” and in the Convention as “..committed with intent to destroy..etc..”.

    The action itemized under points a) to e) do not amount to genocide in the absence of *intention*.

    Since Israel has never had, and does not have, the *intention* to destroy the Palestinian people in part or in whole, it cannot be accused of committing or attempting to commit genocide.

    This is, of course, what distinguishes events in the area of land formerly known as Palestine from what happened in, say, Ottoman Turkey (the Armenian genocide), the Holocaust and in certain areas of Africa (Ruanda, Sudan…).

    Consideration might well also be given to the following.

    Over the last five or six decades there have been innumerably UN General Assembly Resolutions on Israel, Palestine, etc.

    It would be fair to say that few of them are kind to Israel.

    Given Israel’s lack of popularity in the UNGA, it would not be surprising – if MerkinScot and consorts were right – to find more than a few Resolutions condemning Israel for the genocide (whether slow or fast, historical or ongoing)of the Palestinians. Or indeed, of ethnic cleansing (that’sz for you, Daniel).

    There is not one such UNGA Resolution.

    The dead don’t speak. The fact is that the people who used to reside in Israel have already been genocided.

    Many of the people who used to live in Scotland have been genocided. They no longer speak, but cling for protection like the Unionists of Northern Ireland to the genociding nation, because genocider law is better than no law at all. Same in Iraq.

    The aim of Aipac is to create an accomplished result, for which there is conveniently no tense in the English language. Fait accompli. What result? An Islamic society broken down by war and terror, by ichtilaf/ factional infighting. By what means? by paying foreigners to interfere with the politics of the host nation and direct, covert interference.

    I am beginning to disagree with the likes of Rehmat and fedup, that Israel is the driver of war , insecurity, and genocide in the Middle East. Israel’s prima facie reason to exist as a homeland for jewish people ignores the aspirations of all the religions who are attached to the Holy land. Israel should be a pluralist society, not an apartheid .

    The reason for it being an apartheid is that it is a proxy, an outpost, a probe of the Anglosaxon race. Being invited to Aipac is like being invited to the Oscars, a wallowing of self-glory in a highly overrated artistic medium. in the case of oscars, acting and music; in the case of Zionism, the art of pretending to support a venerated religion, while wrecking and colonising the Middle east.

    Hillary Clinton’s target audience is not Israelis, who are indoctrinated to racism, but Anglo-saxon colonisers, like Kissinger, Petraus, McCain, Cameron and Blair.

    Craig is right to try to separate that corner of the English speaking world that has experienced Anglosaxon genocide from the part that is driven by dreams of stolen power in spite of two world wars!

    Strictly speaking, on 19 October 2000 the UNHRC designated Israel’s conduct as crimes against humanity instead of genocide. At the time, crime against humanity was the customary international law precursor to genocide. It is what the Nazis did. Now, however, the universal-jurisdiction law of crimes against humanity has been codified in Article 7 of the Rome Statute as any of the following acts:

    (a) Murder;

    (b) Extermination;

    (c) Enslavement;

    (d) Deportation or forcible transfer of population;

    (e) Imprisonment or other severe deprivation of physical liberty in violation of fundamental rules of international law;

    (f) Torture;

    (g) Rape, sexual slavery, enforced prostitution, forced pregnancy, enforced sterilization, or any other form of sexual violence of comparable gravity;

    (h) Persecution against any identifiable group or collectivity on political, racial, national, ethnic, cultural, religious, gender as defined in paragraph 3, or other grounds that are universally recognized as impermissible under international law, in connection with any act referred to in this paragraph or any crime within the jurisdiction of the Court;

    (i) Enforced disappearance of persons;

    (j) The crime of apartheid;

    (k) Other inhumane acts of a similar character intentionally causing great suffering, or serious injury to body or to mental or physical health.

    So genocide or not is simply a matter of preliminary plea bargaining in a charter body, and not dispositive with respect to future verdicts under international criminal law. By the time Israel’s Zionazis get through with their unprecedented macro-scale concentration camp called Palestine, the world may well need a entirely new legal term.
